Court orders police to pay 10million for accidentally shooting a man

A Federal High Court, Lagos, yesterday awardedN10 million as damages against three policemen for negligently and recklessly shooting one Darlington Amaiham in the leg in 2012.

The trial judge, Mohammed Yunusa, awarded the sum while delivering judgment in a fundamental rights enforcement suit filed by the applicant, asking for a declaration that the reckless shooting by the respondents, amounted to a violation of his right to life.

The respondents in the suit are: The Nigeria Police, Inspector General of Police, Commissioner of Police Lagos State, Insp Usman Shehu, Cpl Alex Edomagbon, and Cpl Seun Adewale.

Amaiham had filed the case on Sept 19, 2012 through his counsel Joseph Odeh of “Access to Justice”, seeking the enforcement of his fundamental right against the respondents.

The applicant had claimed the sum of N10 million as general damages over his “reckless sporadic shooting” by the fourth to sixth respondents, which he said has left him incapacitated.

He also claimed the sum of N5 million as exemplary and aggravated damages, plus the sum of N128, 800 as special damages for his medical expenses.
