Supreme Court Defers Ruling on Tinubu’s Rivers Emergency Declaration

The Supreme Court, led by a seven-judge panel under Justice Inyang Okoro, has deferred its ruling on a lawsuit contesting President Tinubu’s March 2025 declaration of a state of emergency in Rivers State. The court adjourned the case on Tuesday, October 21, 2025, after hearing arguments from all parties involved.The plaintiffs, comprising the Attorneys General of 10 states, are challenging the Federal Government and the National Assembly. During the proceedings, Delta State, the fifth plaintiff, withdrew from the lawsuit, a move unopposed by Lateef Fagbemi (SAN), counsel for the Federal Government.Representing the plaintiffs, Jegede (SAN) clarified that the lawsuit does not question the President’s constitutional power to declare a state of emergency. Instead, it focuses on the declaration’s scope, particularly its implications for the roles of the governor, deputy governor, and the Rivers State House of Assembly.The court will deliver its judgment at a later date, pending further review of the arguments presented.
